Pass Guarantee Terms

Important Notice to Consumers: This Pass Guarantee is a voluntary commercial warranty provided by RouteBuddy. It does not affect your statutory rights under the Consumer Rights Act 2015, the Consumer Contracts Regulations 2013, or any other applicable UK consumer protection legislation.
1. Scope, Category Restriction & Eligibility Criteria
The RouteBuddy Pass Guarantee provides a conditional financial remedy where RouteBuddy reimburses a user's last test booking fees if they fail their official practical driving test. To be eligible for this driving test fee reimbursement, the user must satisfy all of the following core requirements:
- Vehicle Category Restriction: This Pass Guarantee is valid exclusively for Car (Category B) learner drivers within the UK. It does not apply to any other vehicle categories, including but not limited to motorcycles, large goods vehicles (LGV), passenger carrying vehicles (PCV), or professional instructor tests.
- Premium Subscription: The user must have a fully paid, active RouteBuddy Premium subscription prior to the time of the official practical driving test.
- Location: The user must book and sit their official practical driving test with the Driver and Vehicle Standards Agency (DVSA) within Great Britain (GB). Please note: This guarantee does not apply to driving tests taken with the Driver and Vehicle Agency (DVA) in Northern Ireland.
- Targeted Route Practice: The user must have practiced at least three (3) distinct car routes using the RouteBuddy app at the exact same test centre where their official practical test was taken, prior to the failed attempt.
- Test Recording: The user must have recorded their official driving test session using the application's telemetry/GPS tracking features as evidence of active intent and navigation alignment.
2. DVSA Test Fee Reimbursement Caps
If a claim is fully validated and approved under the terms of this guarantee, RouteBuddy will issue a direct cash-equivalent payout to reimburse the cost of the failed practical driving test up to the official standard DVSA fee rates for car practical exams. This guarantee does not provide a refund for the RouteBuddy application purchase or premium subscription fees. The maximum driving test fee reimbursement caps are defined as follows:
- Standard Weekday Test (Monday – Friday daytime): Official DVSA Fee Rate of £62.00 (Maximum RouteBuddy Test Fee Payout Up to £62.00)
- Weekend, Evening & Bank Holiday Test: Official DVSA Fee Rate of £75.00 (Maximum RouteBuddy Test Fee Payout Up to £75.00)
Note: Any third-party booking agency markup, fast-track finder fees, or vehicle rental fees for the test day are strictly excluded from this guarantee.
3. Verified Usage Density & Telemetry Integrity
3.1 Usage Requirements
Users must demonstrate consistent, high-density active training using the app's features prior to their exam date. "Active usage" is strictly defined as training sessions during which active GPS movement and telemetry are recorded within the app for a continuous minimum period of between thirty (30) and forty (40) minutes per session, in line with standard UK driving test duration.
3.2 Telemetry Integrity & Proxy Driving Protection
To ensure fairness and prevent fraudulent claims, all submitted telemetry data undergoes rigorous automated and manual validation. RouteBuddy reserves the right to deny claims where telemetry logs indicate patterns inconsistent with a genuine learner profile (referred to as "Proxy Driving").
"Proxy Driving" means any session that, in our reasonable judgement, does not appear to have been carried out by the registered learner driver. We reserve the right to update our criteria for identifying Proxy Driving at any time.
In the event that a claim is denied under this section, the user has the right to appeal the decision within fourteen (14) days by contacting our Escalations team, providing corroborating evidence (such as a signed log from their approved driving instructor (ADI) or supervising driver).
4. Statutory Cancellation & Consumer Rights
In accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, online purchasers have a statutory right to cancel their digital subscription within fourteen (14) days of purchase and receive a full refund.
However, if you explicitly consent to start using the premium features of the RouteBuddy app within this 14-day period, you acknowledge that you waive your statutory right to cancel.
5. Privacy & Data Protection (UK GDPR)
RouteBuddy collects, processes, and stores telemetry, GPS location coordinates, and user behavioural data to verify compliance with the terms of this guarantee. All data processing is carried out in strict accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Our lawful basis for processing this data is the performance of a contract to which the data subject is party. 6. Claim Submission, Forfeiture, and Payment Disputes
6.1 Claim Submission Process
All claims must be submitted digitally by the learner. To initiate your practical test fee refund process and upload your supporting files, you must be redirected to the official RouteBuddy Claim Portal. To process the test fee payout successfully through this portal, the user must upload their official DVSA car test fail sheet / certificate (Form DL25) matching the registered user's identity
6.2 Automatic Forfeiture
Successfully receiving a software-level refund for the RouteBuddy app purchase via any channel (including store-level payment provider refunds like Apple App Store or Google Play) will immediately void this guarantee and disqualify any pending or future test fee reimbursement claims.
6.3 Resolution of Chargebacks and Payment Disputes
Consumers retain the full statutory right to raise payment disputes or chargebacks through their card issuer or bank under the Payment Services Regulations 2017 and Section 75 of the Consumer Credit Act 1974. Initiating a payment dispute or chargeback will not result in an automatic account ban or platform penalty. However, any chargeback resolved in the consumer's favour that covers the initial purchase price of the subscription will render the contract void and immediately invalidate any pending Pass Guarantee claims.
7. Alternative Dispute Resolution (ADR)
If a dispute arises regarding a Pass Guarantee claim and cannot be resolved through our internal customer support channels, you will be provided with a final deadlocked response. RouteBuddy is not currently a member of an approved Alternative Dispute Resolution (ADR) scheme. If you remain dissatisfied with our final response, you may seek independent legal advice or contact Citizens Advice to explore external resolution avenues.
8. Governing Law & Jurisdiction
These terms and conditions, and any dispute or claim arising out of or in connection with them, shall be governed by and construed in accordance with the laws of England and Wales. Any legal proceedings must be brought within the exclusive jurisdiction of the courts of England and Wales.
